These Terms of Use govern access to and use of the website at nicl.ai, operated by Energized Response, Inc., doing business as Nicl ("Nicl," "we," "our"), a Denver, Colorado company. By using the site you agree to these terms. If you do not agree, please don't use the site.

Acceptable use

You agree to use the site lawfully and in a way that doesn't interfere with anyone else's use of it. That means no scraping at a rate that degrades performance, no attempting to bypass security or authentication, no uploading malicious code, and no using the site to send unsolicited communications or infringe someone else's rights.

Intellectual property

The site and its content — writing, design, code, logos, and other materials — are owned by Nicl or its licensors and are protected by intellectual property laws. You may view and share the content for personal or internal business purposes, with attribution and a link back where appropriate. Republishing substantial portions or using the Nicl name or marks commercially requires our written permission.

Informational content, no warranty

Articles, frameworks, and other materials on the site are provided for general informational purposes and reflect our views at the time of writing. They are not advice for your specific situation, and we make no warranties about the accuracy, completeness, or suitability of the content. Use it at your own discretion.

Limitation of liability

To the fullest extent permitted by law, Nicl is not liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or its content. Our total liability in connection with the site is limited to the greater of one hundred U.S. dollars or the amount you have paid us for site access in the twelve months preceding the claim.

Services engagements

Consulting, advisory, and implementation services provided by Nicl are governed by a separate written agreement between Nicl and the client. Nothing on this site constitutes an offer, engagement, or service commitment on its own.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising out of or related to these terms or the site will be resolved exclusively in the state or federal courts located in Denver, Colorado.
